This End User Licence Agreement (the "Agreement") comprises the agreement with the only user, which is either you, your employer, or any other person who authorised you to sign this Agreement (hereinafter referred to as the "Licensee"), and OOO Flysound, the owner of the Sound Effects Library (the "Licensor").

Licensor is the creator and the owner of the Sound Effects Library, which specific content is available for the public and available for download on the according page of the Licensor's domain at www.flysound.ru. Licensor guarantees that your using of the Sound Effects Library does not infringe property or intellectual property rights of any third parties.

All the content available on any pages within this domain, including, but not limited to, subpages, text, sounds, images, logos, diagrams, photos, videos, is copyright in accordance with the current law regulating rights regarding creation works, performing, trademarks, service marks, company names and brand names. It is prohibited to copy, change, sell, transfer or use the materials published on the website without the permission from flysound.ru

As all the purchases are digital and cannot be returned, all the transactions made on this website are irrevocable. No part of the information presented on this website should be understood as contradicting to the stated above. Each page of the Licensor's domain where the according Sound Effects Library is located, contain a demo file (preview) that gives the Licensee the possibility to get acquainted with the samples of sound files. By using Sound Effects Libraries or copying any materials from this website you agree to indemnify OOO Flysound for any loss or damage (including costs of litigation) that can directly or indirectly result from your using of the libraries or using of any information gained through this website.

By accepting the terms of this Agreement, the Licensee gives to the Licensor the consent to processing their personal data, either automated or not, which specifically means consent to actions specified by the Federal Law of 27 July 2006 N 152-FZ ON PERSONAL DATA, Article 3, Section 1, Clause 3, relating to information containing personal data of the Licensee, with the purpose of preparation of tax and statistical reporting and other infromation in accordance with the law, as well as with the purpose of preparation of internal documentation of the Licensor. This consent is valid from the day of the signature of this Agreement and remains in force until its written withdrawal. Licensor agrees to use such data as strictly confidential, unless otherwise is directly required by the current law (demands by law enforcement bodies, judicial authorities, etc.).

By this Agreement the Licensor gives you non-exclusive, perpetual right to playback or use in any other way in any country of the world, the content of the Sound Effects Library purchased, observing all the terms and limitations described in this Agreement, which includes in particular:

• The right to use the Sound Effect Library on one device at the same time. However, the Licensee may save backup copies of the Libraries on any other digital media.
• The right to use the content of the Sound Effects Library incorporated in audio- and audiovisual works (including games and similar products) created by the Licensee or any third parties associated with the Licensee.
• The right to use the content of the Sound Effects Library by performance or broadcasting by the Licensee or any third parties associated with the Licensee.
• The right to edit and process the Sound Effects Library as part of audio- and audiovisual works created by the Licensee or any third parties associated with the Licensee.
• The right to transfer the Sound Effects Libraries to any digital media to complete the creation of Licensee's products

The Licensee, however, does not have the right to distribute, perform, or playback the content of the Sound Effects Library not incorporated into other products and not synchronised with them. The Licensee cannot claim the right of ownership or authorship of the content of the Sound Effects Library, delivered under this Agreement, as well as the right of ownership or authorship of the Sound Effects Library as a whole.

Licensee does not have the right to sell or to give for free any hard disks, disks or any other digital media that contain the content of the Sound Effects Library purchased under this Agreement.

The Licensee cannot claim the right of ownership or authorship of the Sound Effects Library or Sounds. The Licensor reserves all the intellectual property rights regarding marketing and sales of all the Sound Effects Libraries created by the Licensor, and any infringement of the Licensor's rights stated above will result in appropriate legal implications.

Licensor is not responsible for any property damage or moral damage, including direct or indirect losses caused to the Licensee due to the usage of the Sound Effects Library of the Licensor.

Rights of the Licensee are terminated without further notice in case of any breach of the terms of this Agreement. If this occurs, the Licensee must delete all the copies of the Sound Effects Libraries created by the Licensor. Non-compliance with the conditions stated above will bring in force the provisions of the "Intellectual property rights" section of this Agreement.

This Agreement comes into force from the date of the purchase and is valid indefinitely.

This Agreement is subject to the law of the Russian Federation. The Licensee agrees to the sole jurisdiction (including judicial jurisdiction) of any actions relating to this Agreement.
